This privacy policy (“Privacy Policy”) governs how Jet Expiry Alert LLC (hereinafter referred to as the “Company,” “we,” “our,” or “us”) collects, uses, shares, discloses and safeguards Personal Information (defined below) about each individual, entity, user or visitor (collectively “you” or “your”):
- accessing our website located at jetexpiryalert.com (“Website”) and mobile application, namely, Jet Expiry Alert (the “Mobile App”), and
- using Company’s Services (as defined under Company’s Terms of Service).
By accessing the Website and Mobile App, and/or using the Services, you agree to the terms of this Privacy Policy, and you consent to Company’s collection, storage, use and disclosure of your Personal Information (defined below). Should you not accept and agree with this Privacy Policy, please refrain from using and/or accessing Company’s Website, Mobile App and Services immediately.
Collection of Personal Information
The term “Personal Information”, or personal data, means any information about an individual from which that person can be identified. Personal Information does not include data where the identity of the individual has been removed (i.e., anonymous data).
Company collects, uses and stores Personal Information you provide to us, which may include your email address. We may also collect and store your account login credentials.
Company does not collect your Personal Information without your consent and only if you voluntarily provide such Personal Information to us. We may collect your Personal Information when you access certain features on our Website and Mobile App, including when you create and register a User Account (as defined under Company’s Terms of Service), using the Services, entering a sweepstakes or contest sponsored by the Company or its partners, subscribing to special offers from third parties, contacting customer support, providing us with your feedback in relation to the Services and/or when you submit payment information on purchasing certain products or the Services.
In addition to the Personal Information described above, the Company may collect and store product and inventory data that you input into the Mobile App (including product names, categories, barcodes, and expiration dates) (“Inventory Data”). Inventory Data is stored solely to enable the functionality of the Services. You acknowledge and agree that you are solely responsible for the accuracy and completeness of Inventory Data you enter or upload into the Mobile App. Company does not verify the accuracy of Inventory Data and disclaims liability for any errors, omissions, or consequences arising from such data.
We process Personal Information on the following legal bases: (i) performance of a contract (to provide the Services and customer support); (ii) legitimate interests (to secure, improve, and develop the Services, prevent fraud, and communicate about similar products/services where permitted); (iii) consent (for marketing where required); and (iv) compliance with legal obligations.
Sharing of Personal Information
Company does not sell, trade, rent, lease or otherwise share your Personal Information to third parties.
We may share data with trusted third-party service providers for the purposes of statistical analysis, communication (email or postal mail), customer support, and order fulfillment. These third-party service providers are contractually obligated to use your Personal Information solely for providing certain services/products to the Company. Where any of your Personal Information is required for such a purpose, Company shall take all reasonable steps to ensure that your Personal Information will be handled safely, securely, and in accordance with our Privacy Policy, your rights, our obligations, and the obligations of the third party under the law. Personal Information will only be shared and used within the bounds of the law.
Company may also disclose Personal Information if required by law or if we believe disclosure is necessary to comply with legal obligations, protect our rights or property, or address exigent circumstances to ensure the safety of users or the public.
Automatically Collected Information
As you interact with Company’s Website and Mobile App, we may automatically collect certain technical data about your device and interactions with our Services, including internet protocol (IP) address, browser type, domain names, access times, and referring website addresses. This technical data is used only for operational purposes, security, and statistical analysis. This statistical information is not otherwise aggregated in such a way that would identify any particular user of the system.
Security of Personal Information
Company implements reasonable physical, electronic, and administrative safeguards to protect Personal Information from unauthorized access, use, or disclosure. When transmitting sensitive data (e.g., payment information), we utilize encryption protocols such as Secure Sockets Layer (SSL).
You acknowledge that no data transmission over the Internet or wireless network can be guaranteed. While we take reasonable steps to safeguard Personal Information, we cannot guarantee absolute security, as data transmission over the Internet is inherently vulnerable.
To the fullest extent permitted by law, Company disclaims all liability for any unauthorized access to or use of your Personal Information, unless such breach is caused solely by Company’s gross negligence or willful misconduct.
Company shall not be responsible for any errors, inaccuracies, or consequences arising from data that you manually enter into the Mobile App, including product details and expiration dates. Such responsibility rests solely with you.
Your Rights Under the California Consumer Privacy Act and California Privacy Regulation Act (CPRA)
If you are a Californian resident, you have the following rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). These rights are intended to give you greater transparency, control, and protection with respect to how businesses collect, use, and disclose your Personal Information. Your rights include:
- Right to Know: You have the right to request that we disclose the categories and specific pieces of Personal Information we have collected about you, the sources of that information, the purposes for which we use it, and whether and to whom we disclose or sell it.
- Right to Access: You may request a copy of the Personal Information we hold about you in a portable and, to the extent technically feasible, readily usable format.
- Right to Correct: If you believe any of the Personal Information we maintain about you is inaccurate, you have the right to request that we correct it.
- Right to Delete: You have the right to request that we delete your Personal Information, subject to certain legal exceptions (such as when retention is necessary to comply with law, detect security incidents, prevent fraud, or complete a transaction you requested).
- Right to Opt Out of Sale or Sharing: If we “sell” or “share” your Personal Information (as defined under the CPRA), you have the right to opt out of such sale or sharing at any time.
- Right to Limit Use of Sensitive Personal Information: If we collect sensitive Personal Information (such as government identifiers, financial account details, precise geolocation, or health-related data), you may direct us to limit our use and disclosure of such information to only what is necessary to perform our Services.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your rights under the CCPA or CPRA. This means, for example, we will not deny you goods or services, charge different prices, or provide a different level of service because you exercised your privacy rights.
To exercise these rights, you may contact us via email at support@jetexpiryalert.com or by mail at Jet Expiry Alert, PO Box 1204, La Canada Flintridge, California, CA 91011 USA. You may also designate an authorized agent to act on your behalf. If you use an authorized agent, we may require proof of your written authorization and may also ask you to verify your identity directly with us.
We will confirm receipt of your request within 10 business days and respond within 45 calendar days (with the possibility of an additional 45-day extension, if reasonably necessary, which we will notify you about).
Verification of Requests; Authorized Agents; Appeals (CPRA and other U.S. State Laws). We will take reasonable steps to verify your identity before responding to a request, which may include matching identifying information you provide with information maintained by us. If you use an authorized agent, we may require: (i) a signed, written permission from you authorizing the agent to submit the request, (ii) verification of your identity directly with us, and (iii) proof that the agent is registered with the California Secretary of State (if applicable). If we deny your request, you may appeal by emailing us at support@jetexpiryalert.com with “Appeal of Privacy Request” in the subject line. We will respond to an appeal decision within 45 days, or such period as required by applicable law (e.g., CO, CT, VA).
Sale/Sharing; Targeted Advertising. We do not “sell” or “share” Personal Information as those terms are defined under the CPRA, and we do not engage in “targeted advertising” as defined under certain state privacy laws. If our practices change, we will update this Privacy Policy and provide required opt-out mechanisms, including a “Do Not Sell or Share My Personal Information” link, where applicable. We also do not knowingly sell or share Personal Information of consumers under sixteen (16) years of age.
Your Rights Under the General Data Protection Regulation (GDPR)
For the purposes of complying with the General Data Protection Regulation 2016/679 (“GDPR”), you have certain rights as provided under GDPR and applicable data protection laws in relation to your Personal Information. You have the right to:
- Request access to your Personal Information (commonly known as a ‘data subject access request’). This enables you to receive a copy of the Personal Information we hold about you and to check that we are lawfully processing it.
- Request correction of the Personal Information that we hold about you.
- Request erasure of your Personal Information. This enables you to ask us to delete or remove Personal Information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your Personal Information where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your Personal Information to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
- Object to processing of your Personal Information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel the processing of your Personal Information will impact on your fundamental rights and freedoms. You also have the right to object where we are processing your Personal Information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
- Request restriction of processing of your Personal Information. This enables you to ask us to suspend the processing of your Personal Information in the following scenarios: if you want us to establish the data's accuracy; where our use of the data is unlawful, but you do not want us to erase the data; where you need us to hold the data even if we no longer require the data as you need the data to establish, exercise or defend legal claims; or you have objected to our use of your data, but we need to verify whether we have overriding legitimate grounds to use your Personal Information.
- Request the transfer of your Personal Information to you or to a third party. We will provide to you, or a third party you have chosen, your Personal Information in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
- Withdraw consent at any time where we are relying on consent to process your Personal Information. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain Services to you. We will advise you if this is the case at the time you withdraw your consent.
You may exercise any of your rights in relation to your Personal Information by written notice to Company, using the contact details set out below.
